Acceptance of Terms

Welcome to Nerzia! These Terms of Service govern your use of the Nerzia mobile application and related services.

Eligibility

Age Requirement

You must be at least 13 years old to use Nerzia.

• If you are under 18, you represent that you have your parent or guardian's permission
• We do not knowingly collect data from users under 13 (COPPA compliance)

Account Accuracy

You agree to provide accurate information and keep it updated.

License to Use

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Nerzia for personal, non-commercial purposes.

Restrictions

You may NOT:

• Reverse engineer, decompile, or hack the app
• Copy, modify, or distribute our content
• Use the Service for commercial purposes without permission
• Share your account with others
• Use bots or automated tools
• Attempt to access other users' data

AI-Generated Content

How It Works

Nerzia uses Anthropic's Claude AI to generate test questions and explanations.

No Accuracy Guarantee

Educational Use Only

Nerzia is designed for educational purposes and test preparation only.

• Do NOT rely solely on Nerzia for critical exams (SAT, MCAT, Bar, etc.)
• Always verify important information with official study materials
• Use Nerzia as a supplementary study tool, not a replacement for textbooks

User Responsibilities

Your Content

You are responsible for any feedback or data you provide.

Appropriate Use

You agree to use Nerzia lawfully and appropriately:

• For personal study and test preparation
• Not for cheating on actual exams
• Not to generate content for commercial use without permission

Reporting Issues

If you find incorrect content or bugs, please report them via Settings → Help & Support.

Intellectual Property

Our Ownership

All content, features, and functionality of Nerzia are owned by us and protected by intellectual property laws. This includes:

• App design and user interface
• AI prompts and algorithms
• Branding (Nerzia name, logo, etc.)

Your Data

You retain ownership of your test answers and user-generated content. By using the Service, you grant us a license to use your anonymized data to:

• Improve AI question generation
• Conduct educational research (with your consent)

We will NEVER sell your personal data (see Privacy Policy).

Payments & Subscriptions

Free Tier

Nerzia offers a free tier with daily limits (limited tests per day, limited AI tutor chats, and limited PDF downloads).

Premium Subscription

Nerzia Premium unlocks unlimited tests, AI explanations, full analytics, and more.

All plans include a 7-day free trial for new subscribers (one trial per Apple ID per subscription group).

Billing

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Manage and cancel subscriptions in your device Settings → Apple ID → Subscriptions

Refund Policy

Refunds are subject to Apple App Store policies. We do not process refunds directly.

Disclaimers & Limitations

No Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do NOT guarantee:

• Uninterrupted or error-free service
• Accurate, complete, or up-to-date content
• Success on your exams (results depend on your effort)

Limitation of Liability

Your Risk

You understand that Nerzia is a study aid, not a guarantee of exam success. You are responsible for your own exam preparation, and AI-generated content may contain errors.

Termination

Termination by You

You may delete your account at any time via Settings → Account → Delete Account.

Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Use the Service in a way that harms others or our systems

Effect of Termination

Upon termination, your license ends immediately and your data will be deleted within 30 days.

Changes to Terms

We may update these Terms from time to time. We'll notify you of significant changes by posting the new Terms in the app, sending an in-app notification, and requiring acceptance before continued use.

Continued use after changes means you accept the updated Terms.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, USA.

Arbitration

Any disputes will be resolved through binding arbitration, not in court.

• Arbitration conducted by the American Arbitration Association (AAA)
• You waive your right to a jury trial
• You waive your right to participate in class action lawsuits

Exceptions

You may bring claims in small claims court if they qualify.

Miscellaneous

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Nerzia.

Severability

If any provision is found invalid, the remaining provisions continue in effect.

No Waiver

Our failure to enforce any provision doesn't waive our right to enforce it later.
